The Jefferson jury, meeting in December to evaluate the evidence against the couple, returned the indictments for Patrick Stallworth, 40, and Derick Irisha Brown, 30, which resulted in the death of a child under the age of 14 and the death of a kidnapping. To AL.com.

After a federal grand jury convened earlier this year, the couple is charged with conspiracies for federal kidnapping and the kidnapping of a minor victim, according to the Alabama Northern Territory Law Firm.

McKinney disappeared from a birthday party in Tom Brown Village on October 12, 2019, and ignited an extensive 10-day search for the young girl. Their remains were found in Jefferson County landfill on the night of October 22, 2019.

An autopsy would later determine that the 3-year-old died from suffocation without suffocation, and his system had toxic methamphetamine and Trazodone levels.

Authorities were able to link McKinney’s murder to Stallworth and Brown, who were out at the time, after being caught in surveillance footage at a store near Stallworth’s abduction site, AL.com reported.

Other children said they saw a vehicle that matched the description of Stallworth’s Toyota Sequoia and saw a man in the area trying to give candy to children.

A prosecutor said at a possible cause trial in 2019, investigators found a plastic cover splashed with bloodstains in the living room of Brown’s apartment.

Brown also eventually took investigators to McKinney’s body – but since then both suspects have tried to shift the blame to the other. He told the authorities that Stallworth had forced the young girl to have oral sex, while Stallworth claimed that Brown wanted to keep the boy.

Stallworth told the authorities that after telling Brown “this is not your child,” he suggested “do something sexual to the child” but refused.

Stallworth also told the researchers that Brown “put his hands on Cupcake’s nose and mouth.”

Authorities said at court in 2019 that the same night McKinney disappeared, Stallworth went to a grocery store near his home to buy an energy drink and a pill for erectile dysfunction.

Jefferson County Judge Clyde Jones set a pre-trial court date for both suspects on March 31, according to local station WBMA reports. If convicted of the charges against them, they could face the death penalty.
