Federal prosecutors told a court Monday that Miller had a photo of former President Donald Trump on his shirt that read ‘Take Back America’ and ‘I Was There, Washington D.C., January 6, 2021’.

Prosecutors are calling on Miller, to hold a judge in jail while awaiting trial on charges stemming from the January 6 riots in the country’s capital.

Upon a phone call recorded immediately after his arrest, Miller told his mother, ‘I don’t feel I was doing anything wrong, and now I’m going to jail,’ according to prosecutors. Like most of the more than 300 people facing federal charges in connection with the siege, Miller has documented and commented in detail on what he did that day in his social media posts.

After Miller posted a selfie showing himself inside the Capitol, another Facebook user said, ‘Bro you in ?! Beautiful!’ “I just wanted to blame myself a little bit,” said Miller, prosecutors.

Authorities said Miller joined the mob that violated the Capitol building and later threatened to kill New York Representative Alexandria Ocasio-Cortez and a Capitol police officer.

According to prosecutors, after the Democratic congressman tweeted the word ‘Impeach’, Miller tweeted ‘Assassinate AOC’ to him.

Miller said in a post he made on Instagram on January 10, according to prosecutors, that the officer who shot and killed a woman among the rebels should be executed on television. Prosecutors said Miller believed the officer was a Black man and described him as a ‘reward to be received’.

On January 6, 2021, Miller brought tactical gear, ropes, and potentially a weapon of his own admission to the Capitol, demonstrating that he wasn’t just caught up in the crowd frenzy, but instead came to DC with intent. Prosecutors are interrupting the democratic process of counting and approving the Electoral Board’s votes. A federal magistrate in Texas ordered Miller to be arrested following his arrest on January 20. On February 12, a grand jury in the District of Columbia charged Miller with 12 crimes, including civil strife, obstruction of official trial, and assault, resistance or obstruction of officials.

Miller’s lawyer wants his client to be released from custody, saying he regrets what he did.

“However, he has no history of violence, and unlike many others who were previously released, he did not commit any acts of violence associated with the crimes charged,” defense attorney F. Clinton Broden wrote.

Miller is detained in Oklahoma City. His transfer to Washington is on hold for breaking his collarbone while playing football at the recreation garden in Dallas prison.
